Maybe he's busy thinking creatively and doesn't fit into the MOLD the freaking school system has for him -- one size fits all, baby!

It seems logical that his parents being apart would have some effect on his demeanor in class, but a lot of it could be that Max just works best in a different style than the teacher offers.

Don't give up, Tom! You may feel there isn't a lot you can do, that your hands are tied, and that may be true -- for now. But if you decide it's not worth the battle then you lose (and your kids lose) forever. Decide that you're in it for the long haul and keep working toward what you KNOW is right!
